What are State Laws for DUI Breathalyzers Laws

There are laws governing the use of breathalyzers as a basis for causing arrests. These laws greatly differ from state to state, including the severity of the penalties. It is then advisable to know the specific laws in your state regarding driving under the influence of alcohol.

Some states like Idaho, accept readings from preliminary breath testers (taken from hand-help breathalyzers) as evidence during court hearings. Meanwhile, some states like South Dakota are stricter in gathering evidence for DUI. That is why they don’t recognize readings from any form of breath alcohol analyzers and rely mainly on blood tests.

In addition, penalties for refusing a breathalyzer test also differ from one state to another. Some separate the penalties from the DUI conviction, which makes it really bad news for the convicted.

Laws regarding the placing of breathalyzers in cars are also different. However, even if DUI Breathalyzer laws differ, they do have something in common though—they require you to follow them.
